1. Loan Terms: APR, Repayment & Fees
1.1 APR Range
The Annual Percentage Rate ("APR") is the yearly cost of borrowing expressed as a percentage and may include both interest and eligible fees.
APR ranges for financial products available through the Maitry Finance mobile application (the "App") can be up to 35%. The APR offered depends on factors including, but not limited to:
- Your credit profile and credit history
- The requested loan amount
- The repayment term
- Applicable state laws and regulations
- The underwriting criteria of the lender providing the offer
You will always see the final APR and key cost information before accepting any offer. Our partners are required to disclose pricing according to all applicable federal and state consumer-protection laws.
1.2 Repayment Periods
Repayment terms vary by lender and product. Typical periods range from approximately 3 months (about 90 days) up to 24 months (2 years). Some offers may have shorter or longer terms if allowed by law.
Before entering any agreement, you will receive a repayment schedule specifying:
- Number of payments
- Payment amounts
- Due dates
1.3 Payment Frequency & Methods
Payments are generally fixed, scheduled installments on predetermined dates. Depending on the lender and product, payments may be:
- Weekly
- Biweekly
- Semi-monthly
- Monthly
Repayments are typically via electronic transfer (ACH debit) from your verified bank account, though some lenders may offer other methods. Ensure sufficient funds are available on each due date to avoid fees or penalties.
1.4 Fees & Other Charges
Potential fees may include:
- Origination fees
- Late payment fees
- Returned payment or NSF charges
- Expedited funding or transfer fees (if offered)
All fees will be clearly disclosed before you accept any offer. There are no hidden fees. You will always see the total cost of credit, including all interest and fees.
1.5 Early Repayment
Many products allow early payoff without prepayment penalties. Early repayment may reduce total interest paid. Policies vary by lender and state, so review your agreement carefully.
1.6 Example Cost Disclosures
Before finalizing a loan or cash advance, you will receive a standardized cost disclosure showing:
- APR
- Finance charges
- Total payment amount
- Number of payments and due dates
Review carefully, as it reflects the legally binding cost and repayment terms.
2. Your Agreement to These Terms
These Terms of Use ("Terms") form a binding contract between you ("User") and Maitry Finance LLC ("Maitry Finance," "we," "us," or "our").
By downloading, installing, registering, or using the App, you confirm that:
- You are at least 18 years old (or the legal age of majority in your state).
- You are a lawful U.S. resident.
- You can enter into legally binding agreements under state and federal law.
By using the App, you acknowledge that you have read, understood, and agree to these Terms and the Privacy Policy. If you do not agree, stop using the App.
Continued use after updates means you accept the revised Terms.
3. Purpose of the App & Service Overview
The App provides a secure platform to explore, compare, and connect with financial offers that may suit your needs. Through the App, you can:
- Submit a request including personal, employment, and banking details.
- Be matched with participating financial institutions or service providers.
The App allows you to enter information once and securely share it with partners operating under applicable laws. You can review potential loan or cash advance terms before deciding. Any loan, repayment plan, or credit agreement is executed directly between you and the lender or service provider.
Maitry Finance:
- Provides the technology platform
- Facilitates secure data transmission
- Offers customer support
We do not control or guarantee:
- Lender approval decisions
- Interest rates or APRs
- Repayment schedules or terms
- Lender customer service
These are determined solely by the lender or financial provider.
4. Eligibility & Your Responsibilities
To use the App, you must:
- Be at least 18 years old (or age of majority)
- Be a U.S. citizen or permanent resident
- Have valid identification (e.g., Social Security number)
- Maintain an active checking account
- Have verifiable income
- Provide accurate, complete, and current information
- Use the App for lawful, personal, non-commercial purposes only
You are responsible for your login credentials. If you suspect unauthorized access or misuse, contact support@maitryfinance.com immediately. Accounts may be suspended or terminated for fraud, abuse, or prohibited activity.
5. Electronic Communications & Consent
By using the App, you agree to receive electronic communications from us and, when applicable, our partners:
- Emails
- SMS/text messages
- In-app notifications
- Electronic documents and disclosures
Electronic records and signatures are legally equivalent to paper documents. You may withdraw consent at any time by contacting support@maitryfinance.com, but this may limit App functionality. Legally required communications will still be sent.
6. Account Creation, Access & Maintenance
When registering, you agree to:
- Provide true, accurate, verifiable information
- Keep information updated
Do not:
- Share credentials
- Use another person's identity
- Misrepresent information
We may verify identity at any time and suspend, limit, or terminate access for suspected fraud or unauthorized use.
7. Data Accuracy & Authorization
By submitting information, you authorize Maitry Finance to:
- Collect and process your information
- Share it with participating financial institutions and service providers
- Use third-party tools for verification of identity, income, and bank account ownership
False or incomplete information may result in denial of requests, account suspension, or legal action.
8. Fees, Payments & Compensation
The App is free for consumers. We may receive referral or marketing fees from lenders or partners if you:
- Are connected with them via the App
- Take a loan, cash advance, or other service
Compensation does not change offer terms. Partners must comply with all applicable laws.
9. Permitted Use & Prohibited Activities
You may not:
- Violate laws
- Attempt unauthorized access
- Use robots, scrapers, or automated tools
- Upload viruses or harmful code
- Reverse-engineer the App
- Copy, modify, or distribute content without permission
- Send unsolicited messages or spam
Violations may result in account termination and legal liability.
10. Service Changes & Availability
We may add, remove, or change features, temporarily or permanently suspend the App, or perform maintenance. We are not liable for downtime or changes.
11. Intellectual Property
All content and technology are owned by Maitry Finance LLC or licensors. You receive a limited, non-exclusive, non-transferable license for personal, lawful use. Unauthorized use is prohibited.
12. Disclaimers
The App and services are provided "as is" and "as available." We make no warranties about accuracy, reliability, or completeness and do not guarantee uninterrupted access.
All implied warranties, including merchantability, fitness for a purpose, and non-infringement, are disclaimed. Use at your own risk.
13. Limitation of Liability
To the maximum extent permitted by law, Maitry Finance LLC and affiliates are not liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or goodwill
Total liability is limited to USD $100. Some exclusions may not apply in certain states.
14. Indemnification
You agree to defend and hold harmless Maitry Finance LLC and affiliates from claims, damages, or expenses arising from:
- Your App use or misuse
- Violation of Terms
- Violation of law or rights of others
15. Governing Law & Dispute Resolution
These Terms are governed by Delaware law. Disputes will be resolved by individual binding arbitration under the Federal Arbitration Act. Class actions are not permitted. If arbitration is unenforceable, disputes will be brought in Delaware courts.
16. Termination
We may suspend or terminate access if you violate Terms, laws, or harm others. You may stop using the App by deleting it and closing your account. Sections that survive termination include liability, indemnification, and dispute resolution.
17. Changes to These Terms
We may update Terms from time to time. Material changes may be announced via in-app notifications or email. Continued use means acceptance.
